This Privacy Policy describes how Quest Products, LLC and our subsidiaries and affiliated companies (collectively, “Quest Products,” “we,” or “us”) collect, use, disclose, and otherwise process personal information about you. This Privacy Policy applies to information we collect when you access or use our websites and other online products and services that link to this Privacy Policy (collectively, our “Services”) or when you otherwise interact with us, such as through customer feedback programs or our customer support channels. We may provide different or additional notices of our privacy practices with respect to certain offerings or activities, in which case, those notices will supplement or replace the disclosures in this Privacy Policy. 

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. If we make material changes, we will provide you with additional notice (such as by adding a statement to the Services or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

The categories of personal information we collect about you and the sources from which we collect it depend on how you interact with us or use our Services and are described in more detail below.

Information You Provide to Us

We collect personal information directly from you. For example, we collect information directly from you when you make an online purchase through certain Services, create an account, fill out a form, submit or post content through our Services (such as product reviews), communicate with us via third-party platforms, participate in loyalty programs we offer, request customer support, or otherwise communicate with us. The types of information that we collect include name, email address, postal address, phone number, and any other information you choose to provide, such as information related to your health or caregiving experience in our community support forums or product reviews. Additionally, if you make a purchase from us, we work with a third-party payment processor to collect and process your payment information.

Information We Collect Automatically

We automatically collect certain information when you access and use our Services or otherwise interact with us, including, as applicable:

  • Transactional Information: When you make a purchase or return, we collect information about the transaction, such as product details, purchase price, and the date and location of the transaction.
  • Device and Usage Information: We collect information about how you access our Services, including device information, such as your browser type, hardware model, operating system version, IP address, unique device identifiers, and language settings. We also collect information about your activity on our Services, such as items placed in your shopping cart, your access times, pages viewed, the routes by which you access our Services, and your use of any hyperlinks available within our Services.
  • Customer Service Records: If you contact customer service by phone, we may monitor and retain information detailing those conversations, including for training purposes.
  • Information Collected by Cookies and Similar Tracking Technologies: We (and those that perform work for us) use technologies, such as cookies, pixels, and other tracking technologies to collect information about your browsing and purchase behavior and other engagement with the Services. These technologies help us improve our Services and your experience, see which areas and features of our Services are popular, and understand usage and campaign effectiveness. We may derive personal information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address or infer that you are looking to purchase certain products based on your browsing behavior and past purchases. 

USE OF INFORMATION

We use the information we collect to provide, maintain, and improve our products and services. Depending on your interactions with our Services, we also use the information we collect to:

  • Process transactions and returns and send you related information, including confirmations, receipts, invoices, customer experience surveys, and recall notices;
  • Personalize and improve your experience with us;
  • Send you technical notices, security alerts, support messages and other transactional or relationship messages such as recall notices and customer experience surveys;

TARGETED ADVERTISING AND ANALYTICS

For some of our Services, we engage others to provide analytics and perform related services across the web and in mobile apps. These entities may use cookies, web beacons, SDKs, device identifiers, and other technologies to collect information about your use of our Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information is used to analyze and track data, determine the popularity of certain content and better understand your online activity. 

On some of our Services, we also engage others to deliver advertising targeted to your interests on other companies’ sites or mobile apps. You can turn off cookies used for ad targeting purposes by clicking the “Your Privacy Choices  ” link found in the footer of our applicable websites and following the instructions in the pop-up window. Please note that you will need to exercise this choice on each website and renew your opt-out choice if you visit those websites from a new device or browser, or if you clear your cookies.

DISCLOSURE OF INFORMATION

We disclose personal information as described in the Targeted Advertising and Analytics section above and in the following scenarios: 

  • We disclose personal information to vendors, service providers, contractors and consultants that need this information to provide services to us, such as companies that assist us with web hosting, shipping and delivery, payment processing, fraud prevention, customer service, data enrichment, analytics, and marketing and advertising.
  • If you provide a product review or otherwise post content on our Services (where available), the public and other users of our Services may be able to see this information.
  • We disclose personal information if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.
  • We disclose personal information if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Quest Products, our users, the public, or others.

  • Personal information is disclosed between and among Quest Products and our current and future parents, affiliates, and subsidiaries and other companies under common control and ownership.
  • We disclose personal information when we have your consent or you direct us to do so.

We also disclose aggregated or de-identified information that cannot reasonably be used to identify you. Quest Products maintains this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

Cookies and Similar Tracking Technologies

We use cookies and similar tracking technologies to analyze visits to and use of our Services. You can usually adjust your browser settings to remove or reject all or some browser cookies. You can also adjust certain cookies settings by clicking the “Your Privacy Choices  ” link found in the footer of our applicable websites. Please note that removing or rejecting cookies could affect some of the functionality of our Services, such as remembering your preferred language on sites that offer translation. 

Communications Preferences

You may opt out of receiving promotional emails from Quest Products by following the instructions in those communications. If you opt out, we may still send you non-promotional emails, such as those about your orders.

Other Details about our Information Practices

  • As described in more detail above, we collect personal information directly from you (for example, when you place an order on our Services), automatically when you access or use our Services, from third-party sources, and we derive certain information.
  • We do not knowingly collect, sell, or share personal information about consumers under the age of 16.
  • We generally do not collect information that is considered “sensitive” under State Privacy Laws. In the limited circumstances that we do, such as collection of your account username and password, which is designated as “sensitive” under the California Consumer Privacy Act, we do not use or disclose sensitive personal information for the purpose of inferring characteristics about you.
  • Our retention periods for personal information are based on business needs and legal requirements. We store personal data associated with your account for as long as you maintain an account with us. We retain other personal information for as long as is necessary for the processing purpose(s) for which we originally collected it and for other business purposes explained in this Privacy Policy. For example, we may retain certain transaction details and correspondence until the time limit for claims arising from the transaction has expired. In addition, we retain your email address and information about your marketing preferences to aid us in honoring those preferences.

Your Privacy Rights

Opting Out of Targeted Advertising, Sharing, and Sales

As described above, you have the right to opt out of having your personal information sold, shared, or used for targeted advertising. You may opt out by clicking the “Your Privacy Choices  ” link in the footer of our applicable Services and following the instructions in the pop-up window. Please note that you will need to exercise this choice on each website and renew your opt-out choice if you visit those websites from a new device or browser, or if you clear your cookies. Depending on applicable State Privacy Law, you can also opt out by visiting the applicable Services with a legally recognized opt-out preference signal enabled, such as the Global Privacy Control. 

Access, Correction, and Deletion

You have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. To request access, correction, or deletion of your personal information, please contact us as set forth in the Contact Us section below. Where applicable, you can also update and correct certain account information at any time by logging into your account. If you wish to delete or deactivate your account, please contact us as set forth in the Contact Us section below but note that we may retain certain information as required by law or for our legitimate business purposes. 

We may verify your request by asking you to provide information related to your recent interactions with us, such as asking you to answer questions regarding a recent purchase. 

Authorized Agents

Depending on where you reside, agents may be able to exercise rights on your behalf.

If you reside in California, you may also designate an authorized agent to submit an access, deletion, or correction request on your behalf. We may ask authorized agents to submit proof of their authority to make a request, such as a valid power of attorney or proof that they have signed permission from the consumer who is the subject of the request. In some cases, we may be required to contact the individual who is the subject of the request to verify his or her own identity or confirm the authorized agent has permission to submit the request. Nondiscrimination

We will not discriminate against you for exercising your privacy rights.

Appeals

If we deny your request, you may appeal our decision by contacting us as set forth in the Contact Us section below. If you have concerns about the results of an appeal, you may contact the attorney general in the state where you reside.

Notice of Financial Incentives

Depending on which of our Services you visit, we may provide discounts, rewards, exclusive offers, or other benefits to customers who sign up to join our loyalty program or who participate in a promotional campaign. For example, through our Tecnu Rewards Program, customers earn points for activities such as posting product reviews. These offerings may constitute “financial incentives” or “bona fide loyalty programs” under some State Privacy Laws (for simplicity, we refer to these collectively as “financial incentives”).  If you decide to participate in a financial incentive, we collect personal information from you, such as identifiers (like your name and email address), commercial information (like your purchase history), and inferences. We disclose this information to our service providers, contractors, and consultants who perform services on our behalf and to our marketing and advertising partners, including for the purpose of engaging in targeted advertising and other marketing activities. You can opt into a financial incentive by following the sign-up or participation instructions provided, and you have the ability to opt-out at any time by following the instructions set forth in the applicable loyalty program or promotional campaign or contacting us as set forth in the Contact Us section below. If you request that we delete any of your personal information that is essential to providing you with the financial incentive, we will not be able to provide you with the benefits of that program (e.g., if you ask us to delete your email address, we will no longer be able to provide you with early access to sales or other benefits). In some cases, we may provide additional terms and conditions, which we will provide to you when you sign up. The value of your personal information is reasonably related to the value of the offer or discount presented to you.

For Canadian Customers

If you are a Canadian resident, this section applies to you.

Consent: By submitting personal information to Quest Products, or our service providers and agents, you consent to the collection, use, disclosure, and transfer of your personal information in accordance with this Privacy Policy and as permitted or required by law. 

You may withdraw your consent at any time to the collection, use, disclosure, or transfer of your personal information by contacting Quest Products as set forth in the Contact Us section below. If you withdraw your consent (or if you decide not to provide certain personal information), you acknowledge that Quest Products may not be able to provide you, or continue to provide you, with certain products, services, or information that may be of value to you.

Canada’s Anti Spam Law (“CASL”): Quest Products will only send you commercial electronic messages (“CEMs”) where we have your express or implied consent to do so. Your consent to receive CEMs is implied where we have an existing business relationship with you, or you have reached out to us and made an inquiry within a certain time frame. You may unsubscribe from receiving CEMs at any time, by clicking the unsubscribe button on an email. If you opt out, we may still send you non-promotional messages, such as those about your account or our ongoing business relations.
